By submitting information through this Website, I give my voluntary, informed, and specific consent ("Consent") to CyberCrimesHelp.org ("the Organisation") for the collection and processing of my personal information ("Personal Data"), on the following terms:
1. Scope of Consent
This consent covers the collection and processing of Personal Data, whether carried out manually or through automated tools.
2. Categories of Personal Data Collected
This consent applies to the following categories of Personal Data:
- Name and Contact details;
- Identity documents, where voluntarily submitted;
- Information relating to a cyber incident, including screenshots, transaction details, bank account information, UPI IDs, wallet addresses, emails, digital evidence, and police complaints, or other supporting records, where voluntarily submitted.
Where I voluntarily submit the aforementioned documents or information, I confirm that I am authorised to provide such information.
3. Nature of Personal Data
Such Personal Data is provided directly by the complainant/user and is not publicly available
4. Purpose of Processing
Personal Data is collected and processed solely for:
- Assessing and responding to the grievance, query, or cyber incident report submitted;
- Providing guidance or assistance in relation to such cyber incident report submitted
- Internal record-keeping for quality and accountability purposes
5. Legal Basis
Processing of Personal Data is carried out in accordance with the Digital Personal Data Protection Act, 2023, and this consent constitutes the legal basis for such processing.
6. Actions Performed on Personal Data
The following actions may be performed on Personal Data during processing: collection, storage, use, organisation, correction, retrieval, and destruction. This Consent also authorises engagement of third-party service providers to process Personal Data strictly for the purposes stated in Clause 4 above, subject to the confidentiality obligations described below.
7. Sharing of Personal Data
Consent is given for sharing of Personal Data only with: (a) authorized personnel/volunteers of the Organization directly involved in addressing the matter; (b) law enforcement or statutory authorities, where the user separately elects to route their complaint through such authority, or where required by law; (c) third-party service providers engaged strictly to support the Organization's operations (e.g., IT infrastructure), under confidentiality obligations. Personal Data will not be sold or used for advertising or marketing purposes.
8. Retention
Personal Data shall be retained only for as long as necessary to achieve the purposes stated in clause IV above, or until the user submits a written notice for withdrawal of such consent, whichever is earlier, subject to Clause XI
9. Cross - Border Transfer
Where applicable, and only to the extent permitted under the Digital Personal Data Protection Act, 2023, personal data may be processed or stored using service providers located outside India, subject to appropriate safeguards.
10. Withdrawal of Consent
Consent may be withdrawn at any time by sending a written request to the Grievance Officer at grievance@cybercrimeshelp.org. Withdrawal shall take effect prospectively and does not affect the lawfulness of processing carried out prior to withdrawal.
11. Effect of Withdrawal
The Organisation may be unable to continue providing assistance where Consent is withdrawn. The Organisation may nonetheless retain or process limited Personal Data where required to comply with applicable law, or to establish, exercise, or defend legal claims.
12. Security Safeguards
Personal Data shall be processed and stored using reasonable technical and organisational safeguards, with access restricted to authorised personnel only.
13. Minors
Where information relating to a minor is submitted, it must be submitted by a parent or legal guardian on the minor's behalf.
14. Validity
This consent remains valid until the purposes of processing are achieved or until validity is withdrawn in accordance with clause X, whichever is earlier
15. Independent status
CyberCrimesHelp.org is an independent organisation. Submission of information through this website does not constitute filing of an official complaint before any government, law enforcement or regulatory authority.
16. User Understanding and Acknowledgement
I understand that:
- Submission of information is voluntary.
- I may withdraw my consent at any time, subject to applicable law and legitimate operational requirements.
- Withdrawal of consent may affect the Organization's ability to provide assistance.
- CyberCrimesHelp.org will process my information only for lawful purposes in accordance with the Digital Personal Data Protection Act, 2023 and applicable laws.
I further acknowledge that CyberCrimesHelp.org is an independent non-profit organisation and that submission of information through this Website does not constitute filing of an official complaint before any government authority.
For official legal, financial, banking, or law enforcement action, users should contact the appropriate authority or qualified professional as required.
